1. Service Description

1.1 Overview

KariMoXpress (“the Company,” “we,” “our,” or “us”) provides domestic and international air freight, sea freight, and local courier services, including pickup, delivery, and shipment tracking within Jamaica.

1.2 Air Freight Services

Air freight shipments are transported via airline partners and are suitable for time-sensitive or lightweight cargo. Estimated delivery time: 3–7 business days, subject to customs clearance and destination availability.

1.3 Sea Freight Services

Sea freight shipments are transported via ocean carriers and are ideal for heavy or bulk cargo. Estimated delivery time: 7–21 business days, subject to customs processing and port schedules.

1.4 Local Pick-Up and Delivery

KariMoXpress offers optional door-to-door pickup and delivery services within Jamaica. Pick-up requests must be scheduled in advance and are subject to service availability.

2. Customer Responsibilities

2.1 Proper Packaging

Customers must ensure goods are securely packaged to withstand handling and transport conditions. The Company is not liable for damage caused by improper or inadequate packaging.

2.2 Accurate Documentation

Customers must provide correct and complete shipment details, including name, address, contact number, item description, and declared value.

2.3 Prohibited and Restricted Items

Customers must not ship any item prohibited under Jamaican law, including but not limited to:

Firearms, ammunition, explosives

Drugs or controlled substances

Currency or negotiable instruments

Perishable goods not properly packaged

Hazardous or toxic materials

Counterfeit goods or items infringing intellectual property rights

Violation of this clause may result in shipment seizure, cancellation of service, or legal action.

3. Company Responsibilities

3.1 Standard of Care

KariMoXpress will handle all shipments with reasonable care, consistent with industry standards for courier and freight forwarding services.

3.2 Delivery Commitment

We commit to making reasonable efforts to deliver shipments within the estimated timeframes. However, delivery times are not guaranteed and may vary due to customs, weather, logistics, or unforeseen delays.

4. Pricing and Payment

4.1 Fee Structure

Shipping fees are calculated based on weight (per lb) or dimensional weight, whichever is greater. Additional charges may include:

Processing fees

Handling and documentation fees

Storage or re-delivery fees (if applicable)

4.2 Payment Terms

All payments are due upfront unless otherwise agreed in writing. Business accounts may be eligible for net 30 terms upon approval.

4.3 Non-Payment

Failure to make payment within agreed terms may result in suspension of services and withholding of shipment release until the balance is cleared.

5. Liability and Insurance

5.1 Standard Liability

KariMoXpress’s liability for loss or damage is limited to JMD $500 per lb or JMD $10,000 per shipment, whichever is lower, unless additional insurance is purchased.

5.2 Optional Insurance

Customers may request extended insurance coverage prior to shipment. Coverage and premium details will be provided upon request.

5.3 Claims Process

Damage or loss claims must be submitted in writing within 7 business days of delivery (or expected delivery). Supporting documents such as photos, receipts, and waybill numbers must be included.

6. Prohibited Items

In compliance with Jamaica Customs Agency and Civil Aviation Authority regulations, the following items are strictly prohibited:

Explosives, firearms, ammunition

Flammable liquids or gases

Narcotics or controlled substances

Pornographic or obscene materials

Live animals (without prior approval)

Hazardous waste or chemicals

Human remains

7. Delivery Terms

7.1 Estimated Delivery Timeframes

Air Freight: 3–7 business days

Sea Freight: 7–21 business days

Local Courier: 1–3 business days

7.2 Failed Deliveries

If a delivery attempt fails due to customer unavailability or incorrect address, the shipment will be held for 5 business days. Storage or re-delivery fees may apply.

7.3 Unclaimed Shipments

Shipments unclaimed for more than 30 days may be disposed of or sold to recover storage and handling costs.

8. Force Majeure

KariMoXpress shall not be liable for any delay, loss, or failure to perform due to causes beyond its reasonable control, including but not limited to:

Natural disasters

Acts of God

War, terrorism, or civil unrest

Customs or government actions

Strikes, labor disputes, or port closures

9. Dispute Resolution

9.1 Complaint Procedure

Customers may file complaints by email at [email protected] within 14 days of service completion. We will respond within 10 business days.

9.2 Governing Law

These Terms and Conditions are governed by the Laws of Jamaica. Any dispute shall be settled in the Parish Courts of Jamaica or another competent Jamaican authority.

10. Privacy and Data Protection

KariMoXpress collects and processes customer data in accordance with the Data Protection Act (Jamaica) 2020. Information is used solely for service delivery, customs compliance, and communication.

We do not sell or disclose customer data to third parties except where required by law.

11. Modification of Terms

KariMoXpress reserves the right to update these Terms and Conditions at any time. The latest version will always be available at https://karimoxpress.com.

Continued use of our services constitutes acceptance of the revised terms.

12. Termination of Service

KariMoXpress may suspend or terminate an account or shipment at its discretion for:

Fraudulent activity

Violation of customs or shipping laws

Non-payment or abuse of service

Upon termination, outstanding balances must be settled immediately.

13. Refund Policy

13.1 Eligibility

Refunds are granted only in cases where:

The shipment was cancelled before dispatch

Delivery could not be completed due to carrier fault

13.2 Procedure

Customers must submit a refund request via email within 7 business days of the incident. Refunds will be processed within 14 business days after investigation.

13.3 Non-Refundable Charges

Processing fees, customs duties, and handling charges are non-refundable once incurred.
